BELGARD|rewards PROGRAM GUIDELINES

PROGRAM ELIGIBILITY
Contractors who purchase eligible Belgard products.
(Belgard Rewards is only available in these States at this time: IL, WI, IN, MN, KS, MO, NE, ND, SD, IA, FL.)

PROGRAM DATES
BELGARD Rewards Program will begin 04/01/07.

EARNING POINTS
Points will be awarded according to the following categories:

  • Std Paving Stone Collection - 1point/SqFt
  • Garden Wall Collection - 1 point/SqFt
  • Std SRW Collection - 2 points/SqFt
  • Antiqued Garden Wall - 2 points/SqFt
  • Antiqued Paving Stone - 3 points/SqFt
  • Antiqued SRW Collection - 3 points/SqFt

    Contact your Belgard Sales Representative to learn which products in your area apply to the above categories.

    Points will be not awarded for products if a contractor receives special pricing from their Belgard Sales Representative for those products.

    RECEIVING POINTS
    Reward Participants will receive paperless electronic rewards. Points Statements may be viewed online at the program Web site. Printed statements may also be sent to Program Participants as frequently as monthly or quarterly.

    BONUS POINTS
    Bonus Points may be offered from time-to- time. Please see your salesperson for details or to explain bonus opportunities if known.


    6.  


    POINT LIFE
    All Points issued to a BELGARD Rewards Program Participant (the "Program Participant") will be valid for the life of the Program. Once the Program is discontinued, the Program Participant will have 90 days to redeem Points for Rewards, unless the program is terminated for other reasons. Upon final termination, any and all unredeemed Points (and the value thereof) shall be forfeited and no reward claims shall be honored thereafter.

    NON-TRANSFERABLE/ NO CASH VALUE
    Points are not transferable and are not redeemable for cash. Program Participants may, however, designate alternative travel or merchandise recipients at the time of redemption.

    AVAILABILITY
    All rewards of merchandise, airline and hotel accommodations, and any other travel (the "Travel and Merchandise Services") included in the Rewards Program are available only to Program participants who have received Points as part of this loyalty points-based program. All Points must be redeemed through the Program Redemption Center. Reward items offered are subject to availability.

    REWARDS CATALOG
    Please refer to your electronic Rewards Catalog for the most up-to-date details on Rewards, Point values, and Redemption Information. Information is also included in any printed catalog you have received but may be out-of-date.

    Eligible Participants may redeem points only for items listed in the catalog at the designated point quantities. Should a featured reward become unavailable, a reward of equal or greater value will be substituted whenever possible.

    All Points must be redeemed through the Program Redemption Center.

    GENERAL INFORMATION

    Any tax liability resulting from the receipt of program rewards is the sole responsibility of the Program Participant. This offer is void where prohibited by law.

    Belgard reserves the right to audit, alter or cancel this Program at anytime in its sole discretion, including without limitation, the Program format, Program partners, Program elements, Reward levels and Reward Rules. All such changes may be made without any prior notification to Program Participants.


    13.  


    Belgard, its manufacturers, agents, and employees make no guarantees, warranties, or representations of any kind, expressed, or implied, with respect to items of merchandise or travel, and shall not be liable to Program Participants or any third party for any damage, loss, expense (including, without limitation, attorneys fees), or harm of any nature which arises in whole or in part from the underlying Travel or Merchandise Services, arranged for the Program Participant in connection with the Program.


    14.  


    No Belgard manufacturer shall be liable in the event that performance is made impossible, or by acts of God, civil or military authority, acts of public enemy, war, riots, civil disturbances, insurrections, accidents, theft, malicious damage, fire, explosions, earthquakes, floods, the elements, lightning, wind or fire resulting from any of the foregoing, strikes, labor disputes or any other causes beyond the reasonable control of any Belgard manufacturer.


    15.  


    The Program Rules shall be governed by and construed in accordance with the laws of the State of Illinois, without giving effect to the principles of conflicts of laws thereof.


    16.  


    In the event any dispute arises between any Belgard manufacturer and a Program Participant regarding the Program Rules or any other dispute which is in any way related to the Program, the parties agree that the sole and exclusive forum for the resolution of such disputes will be arbitration to be held in the city of the Belgard manufacturer involved in the dispute before the American Arbitration Association or any successor entity pursuant to the commercial rules of arbitration then pertaining.


    17.  


    If any provision of the Program Rules shall be declared to be invalid, unenforceable or void, such decision shall not have the effect of invalidating or voiding the remainder of the Program Rules. Upon such event, the parties shall in good faith modify or alter the remainder of the Program Rules to effectuate the original intent of the parties.
